Dear Mr. Obama,

Violation of Science

It seems that I am writing to History since I sent you four registered letters in the last nine months and I got no response. A simple reply would provide an expected feedback that the issue is being taken care of addressing my report of USPTO massive violation of science and IP rights neglecting Hydrology on patenting affairs.

This month Americans are commemorating 40 years of man stepping over the moon. But, we must be honest admitting that the technological advancement of modern life can take us to another planets we cannot live in and also makes our lives on earth more challenging since man capacity to develop machinery replacing human muscles drives to sedentariness hurting our physiology and getting worse by new reality of excessive food dragging human existence toward a catastrophic worldwide obesity. Despite the economic meltdown obesity is still growing in all states. By the way, blacks have the highest rates reaching 45.1% in Maine. Studies are appointing that if this trend keeps going Americans will be 85% obese by 2040.

Perhaps the most outstanding human technological advancement was its capacity to handle fire. Wicks were invented around 70,000 years ago by the Stone Age Man and yet Patent Examiners at USPTO still do not understand its functioning issuing flawed patents that harm common knowledge of my Hydrology PhD textbooks addressing fluids moving on porosity systems.

Mr. Obama, have you ever seen any oil lamp or candle working upside down?

Yesterday USPTO issued the patent US US 7,562,509 ‘Exterior building panel with condensation draining system’ on Jul 21, 2009 with a flaw neglecting Hydrogeology scientific literature as well as ignoring the claims of my issued patent US 6,766,817 expanding human knowledge to such complex hydrodynamic functioning.

Today USPTO has a list of 24,496 issued patents associated with the lay expression wick/wicking that are very like hurting common knowledge standing on scientific literature (only 6 address the issues as Unsaturated Hydraulic Flow as the phenomenon on Hydrology textbooks). I got PhD in Soil Science at The Pennsylvania State University and while attending the Hydrogeology course by Dr. Richard Parizek in the fall of 1992 I had around 130 peers students It means that the US has plenty of competent professionals to handle Hydrological issues in the patenting system curbing laypeople that neglect common knowledge on long standing textbooks. None of my textbooks in Hydrology that address fluids moving on porosity has the expression wick/wicking due to the restrict functioning of oil lamps as well as etymology connecting to Thermodynamics of flames in the oil lamp functioning.

Patent US 7,562,509 says the following in the Abstract:

‘ . . . A wicking port connects the upper reservoir to the lower chamber. The wicking port weeps the condensed moisture from the upper reservoir to the lower chamber to drain the upper reservoir.. . . .’

Mr. President in the last 70,000 years man learned that the wicks on oil lamps are on the top and can never be inserted in the reservoir bottom otherwise the oil lamp does not work. My patent US 6,766,817 brings deep insights from Soil Science/Hydrogeology to the Patenting Systems teaching the dynamic between Saturated and Unsaturated Hydraulic Zones as well as a Porosity Spatial Geometry to enhance Anisotropic Flow ensuing a more reliable hydraulic functioning to fluidic devices. Any porous device at the bottom of a compartment has nothing to do with wick/wicking functioning (Unsaturated Hydraulic Flow) which occurs only above the water table reference.

How can you foster Technological Development in the US if the Patenting System is turning their back to Scientific Literature on Hydrology issuing flawed patents?

My simple conclusion by now is that the spreading obesity, economic meltdown and scientific ignorance are just clear evidences of misleading and incapacity of a government to protect simple principles of human existence toward nature balance and common interest of society. You are allowing the malfunctioning of the economic system to burn 30 to 50 trillion dollars for not protecting simple conceptions of financial investment releasing a worldwide crisis that compromises around 100 million jobs. In the core, investment must be a simple operation that people lend their money and get it back plus something else. Cunning Lawyers changed it to something else ran by greed and fears that jeopardizes general interest of society. You are allowing a catastrophic obesity grow because of a change to unhealthy lifestyles. Also, you are allowing the patenting system harm my scientific books with flaws that ignore my IP rights of my ‘scientific discovery’ in Hydrodynamics.

Mr. President, since 2006 in written communication I have been demanding USPTO to stop a massive infringement on my issued patent rights suggesting the following below:

Hire Examiners with background in Hydrogeology and/or Soil Physics so that they have full comprehension of fluids moving on porosity;
Cancel issued patents with scientific flaws. Obsolete patents are cancelled naturally by becoming outdated;
Make a public statement about Hydrology negligence hurting all Hydrological community as well as my project that needs experts in Hydrology to protect the content of my issued claims.
Compensate for my losses since as an inventor filing patents I was not expecting lay people handling hydrology in the examination process by USPTO.
Since USPTO is failing to protect my IP rights my patents should be eligible for time extension of their expiration dates (new demand).
Issue a bill requiring Hydrology be handled by Hydrologists preventing laypeople from harming standing common knowledge in the scientific literature (new demand).

Compromising the expected reliability on leadership increases a chance that the overall crisis never mends itself totally. I hope that nature does not play a random vengeance creating a stronger epidemic flu strain as a toll to our ignorance on its complex functioning. Indeed shrinking our number reduces the burden of anthropogenic imbalance.

The root of my problems with my ‘scientific discovery’ is associated to Americans suffering a broad management crisis. When you nominated on July 13 Dr. Regina Benjamin General Surgeon an overweight female on the top job with the agenda to fight obesity you betray simple leadership rules to wage war on obesity. It is hard for her to sell the fundamentals of a healthy lifestyle when she does not buy it. She is a striking example of personal failure as she bears the understanding to solve her own issues on being healthy and miss it.

Is it more coherent to have a healthy person leading Americans to a healthy lifestyle down the line?

Also, I am expecting that in the future Hydrologists will be handling Hydrology in the patenting affairs.

Mr. Obama, as a baby you learned about the importance of respecting gravity to walk and what happens when you misstep failing to nature principles.
